Drug Offences
In New South Wales (NSW), drug offences are governed by the Drug Misuse and Trafficking Act 1985. These offences are categorized into two main types: summary offences and indictable offences.
Summary Offences
These are less serious offences and are generally dealt with in the Local Court. Examples include:
Possession of prohibited drugs: Having illegal substances in one's possession.
Possession of implements: Possessing equipment used for drug consumption.
Administration of drugs: Using illegal drugs.
Aiding and abetting: Assisting others in committing drug offences.
Indictable Offences
These are more serious offences and can be heard in higher courts. Examples include:
Cultivation of prohibited plants: Growing illegal plants like cannabis.
Manufacture of prohibited drugs: Producing illegal drugs.
Supply of prohibited drugs: Distributing illegal drugs.
Ongoing supply: Regularly supplying illegal drugs.
Conspiring to commit drug offences: Planning to commit drug offences with others.
Penalties
Penalties for drug offences vary based on the type and quantity of the drug involved. They can range from fines and community service to lengthy prison sentences. For example, offences involving large commercial quantities of drugs can carry a maximum penalty of life imprisonment.
